I have checked and the Home Office letter that came with the visa extension says that I can apply for settlement after 5 years residence (essentially 5 year route).CR001 wrote:Assuming you applied in 2013 from within the UK for your extension then yes, you should be able to apply on the rules in place prior to 9 July 2012.
Yes. The letter and transitional provisions may convince them that the previous caseworker made a mistake. It may be unreasonable to penalise you.asadmg wrote:There seems to have been a mistake in my case then I guess, and the extension visa was granted under the new 5 year rules.
My plan is to apply for the ILR in person. Should I take along a letter which states that the ILR is being sought on the old 2 year rule, based on the original entry clearance having been granted prior to 9/July/2012? I can also take a copy of the Transitional Provisions along.
