Fast-track ILR/NTL Vignette renewal

Post by Andrew Mew » Mon May 16, 2016 6:55 pm

I have today been laid off. I am self employed and registered with another agency to work for the same company.
The "new" agency flagged up via HR that my ILR and Vignette was invalid although I had both my current and old passport.
I saw no reason for her to inform my current manager about this as I'm not employed with that their agency, however I am in the process of reading up printing off NTL and trying to fast tract the application so I can get back into work.
I am also going on holiday with family in 2 weeks and can't send off my passport as I will not be able to fly, so It need s to be fast tracked at a cost of £808.00

Is there a loophole or temporary card available until I return or that I am able to work without having to post my passport in?

Any advise will be appreciated.

To avoid confusion & jumbled responses, I have moved your question to its own thread (this one).

Well, strictly speaking, you are permitted to work simply on the basis of having ILR. If you are genuinely self-employed, then you ought not to need to present evidence providing an employer with a statutory excuse against a fine for employing an illegal worker, for you won't have an employer! As you seem to be aware, you have enough evidence to re-enter the UK for an indefinite period.

Agree. Do you consider your agency as your employer? Are they subject to the fines for employing you? How can you be laid off, if you are self-employed?

Apologies for late reply.
Valid point you have both made. Yes I am self employed as a lorry driver and VAT registered and pay my dues to HMRC and have an accountant.

I have for the sake of the exercise applied for my BRP 06/06/16 and now await.
I am working "illegally" through an agency that does not know yet but have to take less wage and crap work to keep me afloat.

You are not working illegally. Don't confuse an employer's lack of statutory excuse as equivalent to employee's lack of right to work.
