UK Tier 2 curtailment period after resignation

Hi there,

I need some advice about what happens if I resign before my visa ends. Am I right in thinking that:

1. Once I resign my employer has 10 days to let the UKVI know that i have resigned and that they need to curtail my visa?
2. That UKVI then decide the date of curtailment and let me know? Will the date of curtailment be from the date of their decision or the date at the end of my employment i.e. I have to give 60 days notice, so would it be after that? I am trying to work out whether I would have to leave either as my employment finishes or just days after, or do they allow you time to pack up and leave.

Also, I am eligible for a 6-moth tourist visa, so if I left the country at the end of my curtailment period, holidayed in Europe for a while and then came back to the UK for a short holiday (with an airfare home) is there any reason they would not let me in on a tourist visa?

Your employer has to notify HO once your employment ends, i.e. once you have left the company.

How long HO takes to send you a curtailment letter varies, it can take a couple of weeks to receive or a few weeks.

60 days curtailment starts from the date of their letter.

You risk not being allowed to re-enter the UK during your curtailment period or as a visitor after a trip to Europe, your choice to take the chance.

That is incredibly helpful - thanks so much for that clarification.

One more thing - if my employer let's UKVI know that I am leaving before I have actually left the company, does that make any difference to how the curtailment works i.e. could UKVI start the curtailment decision-making before i leave the company, meaning I would have less time in the country I finish work?

No, for as long as you are working for your sponsor, your visa remains valid. The should only inform HO once you have left.
