Tier 1 dependent ILR 5 year route

Post by speedshery » Wed May 18, 2016 4:35 pm

Hi all,
Hope you can help and advise on my case.

Myself and my dependents were granted our Tier 2 General Dependant Visa on December 2011 (i.e: before 09 July 2012), however my dependents first entered the UK on August 2012

Our current visa is valid until November 2017.

I am looking to apply for the ILR on December 2016 as I will have completed my 5 years in the UK.

The question is do they qualify for the 2 year dependent route or the 5 years dependent route? Can they apply with me on December 2016?

And if not, and I proceeded with my application on December 2016 do they need to switch their visa?

They qualify with you for ILR. It is the date the visa is valid from that matters re. pre or post July 2012 not the date of entry.

They are under the 2 year requirement.
