ILR Important question

Post by phaninep » Wed May 18, 2016 5:00 pm

Hello Experts,

I received ILR last year and my wife first arrived UK as ILR dependent last year.

If my wife travels to India and have a baby there, How can i bring back my baby back to Uk?

1) I was told that i have to apply the visa for baby as ILR dependent from india and bring her to UK.

But once baby is in uk can i apply for Brit passport for baby?(as im in ILR)

Or

Does the baby need to spend 5 years in UK as ILR dependent and then only she can apply for brit passport!!

Please help in answering!

Regards
Phani

A child born abroad has no entitlement to British citizenship or a passport. Your ILR status is irrelevant if the child is born abroad.

The child will need a visa exactly the same as your spouse and will qualify for ILR when your spouse does. Only once the child has ILR and either of the parents has British Citizenship, can you apply to register the child as British on form MN1. Once this process is approved, then you can apply for a passport.

If the baby is born in the UK, then the baby will be automatically British and you can apply for a British passport directly.
