Tier 2 sponsorship curtailment & Tier2 to Tier2 application

Dear all,

First a little information about me. My employer sponsored me last year and I started working for them from November 2015 with Tier2 Visa. I applied Tier 2 visa from outside the UK/EU. After five months,that's to say in March 2016, my company decided to redundant me and my employment was terminated at the end of March. After I left the firm my employer also confirmed that they contacted with HO informing them that my employment was terminated.

now I have two questions regarding my current situation.
1. So far, I have not received any letter from HO. My address is the same as the one I provided to the firm before I left. I am worrying about it now because it has been almost 50 days since my employment was terminated. Will there be any chance of me not receiving the letter although the HO has already sent it out? or they use Signed Mail so that we both can make sure that the letter is arrived?
In this case, what action should I take? I can read from other thread that some people suggested taking no action and just waiting, but is not this too risky? Should I contact with the HO?

2. I now secured a position in another company which will likely sponsor my visa soon. However, I am looking to apply graduate schemes again to do a job which I am keen on. By the time I start my graduate scheme job, will I be considered as experienced worker or new entrant? I will be 26 in September 2016 and will probably start working in April 2017 if i am successful with application. So in this case, will the new salary threshold for experienced workers apply or I can be considered as a new entrant?

I never received the HO letter when my employment was terminated in 2010. I then spoke to an immigration lawyer about it and they advised to act as if I had received it. I eventually got another sponsor, but the letter never ever came.

I have read the following from another source and this was the explanation of a representative from HO.

"Dear Madam,





Thank you for your email correspondence of 25 August. I am sorry for the
delay in replying to your email.



In order to request a curtailment notification letter please make your
request in writing to:



Manchester Curtailment Team

PO Box 99

Manchester

M90 3RR



If you have requested a curtailment letter following your sponsors licence
being revoked or surrendered please note that we do not routinely take
curtailment action on an ad-hoc basis and are therefore unable to action
your request at this current time. However, please be assured that UKVI
will issue a curtailment letter to you in due course.



It is not a requirement that you have a curtailment notice in order for
you to find a new sponsor or make another application for leave to remain
in the United Kingdom as long as you have valid leave to remain in the
United Kingdom.



If you have received a curtailment notice via email and you are either
outside of the United Kingdom or unsure as to why you have been sent this,
please note that Curtailment is mandatory because if you have stopped
study or work under paragraphs 323A.(a)(i)(2) and 323A.(a)(ii)(2) of the
Immigration Rules.

From this I can read that "please be assured that UKVI will issue a curtailment letter to you in due course". Does this mean I will be safe to stay in the UK until I receive the letter from the HO?

Please HELP!!!!!

Curtailments team have a substantial backlog of cases. Do not expect your letter for weeks if not months after your previous sponsor advises UKVI.

In the interim you have valid leave and are allowed to remain in the UK. If you have found another Sponsor get them to issue a COS and apply for a new visa.

Experienced salary rate will kick in if the COS that is issued will take you beyond Three years one month from your initial tier 2 visa. So in this case it would therefore you need to be paid the upper rate to succeed with your visa application.

Thank you for your advice.

However, if the UKVI send us the letter, do they notify us with an email or something at the same time? Otherwise how do we both make sure that I received the letter?

There is no email. Letter only, it is sent by special delivery so it has to be signed for.
