Extension of stay based on long stay

Post by DCD » Mon May 23, 2016 10:42 pm

Hello,

Me and my family have been in the UK since 2009 on a Tier 4 visa. My husband and I came in 2009 (though we left the country for 2 years in between for maternity leave, and for research in India for (my UK based PHD). We came back to the UK in Sept 2012 (with our 18 month old son). Our son is over 5 years old now and only knows the UK as his home.

I now have a PhD and our current visa is valid till July 2009. Is it possible for us to get an extension for a 2 years based on long stay criteria? I want to use this time to find an 'appropriate' Tier 2 job (rather than any job)

Would appreciate any guidance on this subject.

You don't appear to have posted the correct expiry date. :?

Sure about your dates of visa expiry?

You don't have long residence. You were out of the UK for 2 years. Any time spent in the UK before returning in Sept 2012 is irrelevant and lost now.

Your son is small, he can adapt to a different country. He has no extra rights because he 'only knows the UK as his home' for the last 3.5 years. That is what HO will say.

Unless you or your spouse find a sponsor for Tier 2 General before your visa expires, there isn't really any route for you.
