Tier 5 to tier 2 visa

I'm from New Zealand, currently on a tier 5 visa but switching to a tier 2.

To cut a long, complicated story short, several months ago I found out I have a son back in New Zealand. Since speaking to the lawyers assisting with my tier 2 visa I have found out this invalidates my tier 5 visa.

Now completing my tier 2 application and listing my son, I am concerned this will raise questions and possibly issues as he was not listed on the tier 5 application.

I am unsure of the best way to approach this, who to speak to and how I can ensure I am not accused of deception. Lawyers are also unsure as it's not a common situation.

My son will not be travelling with me to the UK, he will remain in New Zealand.

Your presumably have a T5 YMS visa and your lawyer knows all the details of your case, which you haven't disclosed here, and s/he advised you accordingly.

However, you would only have been ineligible for the T5 YMS visa if at the time of the application you either had children who lived with you or children you have been financially responsible for. If you didn't even know that you had children neither of these exclusions would have applied and there was no deception.

In your T2 application you should explain the situation either under "additional information" or in a covering letter" and provide supporting documents.
