confused about ILR dates

confused about ILR dates

I arrived to the UK under fiance visa on 12/10 having to switch to spouse visa by 06/11; there was a discrepancy in the photos and application was refused, made a fresh application through lawyer which was again refused, but under the circumstances at the time I was granted a Residence permit with Limited Leave to Remain in 08/11 expiring in 08/14. Travelled back to home town to apply for spouse visa before 08/14. My spouse visa was issued 12/13 to expire 09/16. The question is, can I now apply for ILR and british citizenship? Thank you

No. Unfortunately, an application for spouse entry clearance from 09 July 2012 puts her outside the transitional provisions and under Appendix FM. They correctly granted her a new 33-month spouse entry clearance on 12/13.

She may apply for SET(M) no sooner than 28 days prior to her 5th anniversary of her initial entry on her spouse entry clearance that was issued on 12/13.

She may apply for FLR(M) shorty prior to expiry of leave.
