TIER 2 General .. Do i need to resign in India

Hi,

My employer has generated my COS for UK employment on a Tier 2 General Visa. However, due to some finance issues, he is asking me to join India office and then file Tier 2 General application with COS. In case the visa application issue is successful, do i have to resign from India office first and then join them in UK?

Any help would be appreciated ..

Assuming it's a restricted CoS that the employer has assigned to you.

Resigning or not resigning is not an immigration issue. Depends on your employer's policy. What are they saying? You can travel to UK as long as your visa is approved.

Yes it's a restricted cos .. I would travel when the visa comes and join the uk office ...

Technically, you have to resign, as your employment in India, is currently with the Indian Legal Entity of your employer, and post your relocation to UK, employment will be with Legal UK entity. However, like moonlight has mentioned, its not an 'immigration' issue.

Also, please note that you have to move/change/resign from job (in your case, resign) to be able to withdraw Provident Fund (PF) which you might have accrued during your employment in India.
