Hello

This is my first post on this board having been referred by a friend. I am a mother of three children was divorced in 2012, kids are living with father who is married to British citizen after divorcing me. I have access right to see the children according to divorce arrangements and divorce decree issued by court, (clearly states that mother can see the children whenever needed). I see my children on weekend. children are father's dependents and have got limited leave to remain in line with fathers leave.

i do not have any immigration status at the moment my leave expired in 2012 i did not travel back since my children were here. I am living with a family friend but now i need to file a visa application on the basis of my relationship with children and right to access the children.

I would really appreciate if someone can tell me what application to file and what sort of documents will i be needing to file the application.I do not work therefore I can not afford to pay a solicitor therefore i need an honest and legal advice please!

You clearly don't fall within the Parent Route, and within the immigration rules either.

You will need to seek leave outside the rules, with the Secretary of State exercising treaty right, taking account of the situation of your case and the order of the court. However you do not fall within the ambit of the rules. Any leave granted will be on an exceptional basis outside the rule.

You may also wish to consider a fee remission application due to your circumstances, as a paid FLR(FP) may cost close to £1400 , having regards to the NHS surcharge.
