Settled person (PR) sponsor for non EU spourse

Post by Qwerty121 » Thu Jun 02, 2016 11:19 pm

Hello
Need your advise, please.
I am non EU citizen with PR in UK,currently living in uk.
Got married to non EU outside UK.
1) if we want to live in uk together what visa we need to apply? ( if that family of settled person visa) I
Want to clarify something
Is itcompulsory to pay IHS fee?
Is it necessary to do English exam ? What are other option? What are requirements regarding my salary as sponsor(and me having mortgage and some saving are any help with it?)

Can we apply for short stay visa and then for family of settled person from UK, and if me having naturalisation gives any advantage?
Many thanks

Do you mean that you have PR under the EEA Regulations through a connection with an EEA citizen or do you mean that you have ILR under the UK Immigration Rules?
Qwerty121 wrote:Is itcompulsory to pay IHS fee?
Yes
Qwerty121 wrote:Is it necessary to do English exam ?
Yes, unless the non-EEA spouse can prove that she has completed a university degree in English by getting a letter from the university and getting the university degree appraised by UK NARIC.

A gross (before tax and other deductions) annual salary of £18,600 or savings of £62,500.
Qwerty121 wrote:Can we apply for short stay visa and then for family of settled person from UK,
No

Nope. Family of a settled person visa is the same visa and has the same requirements for both people on ILR and British citizens.

@Qwerty121,
Kindly refrain from multiple posts of same question across the forum.

This topic will do.

Its getting late in Western Europe, night owls and interested members will no doubt respond if/when next available.

Thanks you a lot, with your help I have some clarity on that matter.
But now i have 2 more questions
1) what is the minimum English knowledge requirement for that type of visa, and where to have that exam outside the UK( I guess it has to some places licensed by ukba)
2) what are my other options to bring my spourse to uk? ( I'm considering it as my wife is not confident with English)
I thought to apply for short term visa(up to 6 months, and on months 5 try to pass an exam then just before the end of visa try to upgrade it to family member of the settle person , but from inside the uk, it would enable us to live together rather then me commuting). Just not sure if it legally possiable?
May be there are some other options?
Thanks

1. See Approved English Test Centres (click). She needs level A1 English. October this changes to level A2 English

2. Difficult for a spouse to get a visitor visa for the UK as they have to prove they are 'genuine visitors' and that is hard when the spouse lives in the UK. What ties to home country will your wife prove and provide to ECO? 6 months is not 'visiting' but considered 'residing'. Even if she gets a visit visa, she is not allowed to 'switch/upgrade' to any other visa category within the UK. She has to apply for a spouse visa from her home country.
