7 year child concession rule

Post by t2ictilr » Fri Jun 03, 2016 10:34 pm

My elder son came to UK in Sep 2008 as my wife's Tier 2 (ICT) dependent and went back to India after 5 months in Feb 2009. Again after 10 months break came back to uk on same Tier 2 (ICT) dependent visa of my wife in Dec 2009. In Jan 2014, after about 5 years 5 months (from original Sep 2008 date), we converted my wife and son to FLR (M) category. As there was 10 months break, we felt that they will not be eligible for ILR and hence did FLR(M). Now they completed 2.5 years in FLR (M).
I am about to apply extension of FLR(M) for my wife and son. I want to know if my son will be eligible for ILR under SET(F) - 7 year rule, as he completed more than 7 years, ofcourse with a break of 10 month.
Can some one help me answer this question.
He was a Tier 2 (ICT) dependent from Sep 2008 till Jan 2014 (with 10 month break in 2009) and on FLR(M) from Jan 2014 till June 2016.

Appreciate any help in this regard

The 7 year child concession rule leading to ILR was removed ages ago, certainly before 2012. This article suggests that it was removed in 2008.

Now a child who has lived in the UK for at least 7 years would be eligible for FLR(FP) in their own right (i.e. not as a dependent), provided they can show that it would be unreasonable for them to leave the UK.

They would be eligible in the usual way for ILR after 10 years of legal residence, including any spells on FLR(FP).
