Non-EEA ,Reconciled after separation

Hi, I hope someone will be able to assist me on this .
Both Non- EEA, I came here to join my wife in April 2009, we lived together until July 2012. In June 2012 both our visas were up for renewal however due to our marital problem at the time, she didn’t include me in her renewal. On assistance of my lawyer, I applied for an FLR on my own which has been refused on few occasions but I’m still engaging HO. We have now reconciled and are back together and are making plans to move together again.
Do I have to submit a new application while I’m here , or just inform HO on our current status or do I go back home and re-apply from there .please advise .

Do you currently have a visa? what is your wife's status in the UK.

She has an Indefinite Leave to Remain and I do not have a visa yet , my FLR was refused and I was given an out of country right of appeal , however we have been challenging that , i'm waiting for HO's further response .
