Transfer of employment (TUPE) and spouse visa financial thre

Hi
If a person has been working for an employer for more than one year but now the contract where he is working on is transferring to New company and he is also transferring to New employer. Then does that situation will fall in group A or group B as the transfer of employment is under TUPE regulation??
