Apply for tier 2 visa?

Apply for tier 2 visa?

Hi there,

This is my first post in here and I wondering if anyone could give me some advice.

I am from Hong Kong and currently under a Tire 5 YMS visa which is going to run out on August. My company really want to keep me working in UK and they are willing to sponsor me, however the HR lady told me that there is no way to help me to apply for a Tire 2 visa due to I am not a degree holder. Would anyone know is there any other way out to do the work visa?

My company even got a office in Hong Kong and they are looking into hire me through Hong Kong and transfer me to UK, do this need to be degree holder as well?

she is wrong. The job needs to be at nvq level 6, but u dont need a degree.
if you plan to permanently settle here, then u should go and convince them for tier 2 general.
The tier 2 gen ICT ( if u get transferred from hong kong) will not lead to any sort of settlement.

Thank you very much, does it mean as long as my job is at nvq level 6 and matched the salary requirement then I will be able to get the Tier 2 visa?

Is the position on the shortage occupation list? If not, the employer will first have to fulfil the Resident Labour Market Test (RLMT) by advertising the vacancy in the UK.

Sorry to pour cold water on your potential return under Tier 2

The issue you have is that Tier 5's returning as Tier 2 General is a difficult route. The problem is one of pre selection and the high likelihood of the RLMT being "adjusted" to ensure you are the successful candidate.

It is a well worn known abuse and there is a reasonable percentage chance that the RCOS will not be granted or you get refused a visa if it is granted.

What about all the highly-qualified, highly-skilled and highly-experienced UK (& European) degree-calibre candidates who could do this job?
