Children under 18 born in India to settled parents

Post by Rahul Shah » Fri Jun 10, 2016 11:14 pm

I came in the UK in 2008 on student visa, I got Tier 1 General on March 2011 until March 2014.

I have applied for my wife and childrend for Tier 1 dependent and brought them to the UK as a dependent of Tier 1 ( General ).

After staying with us for 6 weeks my both childeren ( Under 18 years ) left UK and continued thier study in India.

I have applied for Tier 1 ( General ) extension with my wife and got visa until April 2016 but did not applied for my childeren who were studying in India and their previous visa was expired.

Recently in Feb 2016 applied for ILR with my wife and we both got the ILR now.

We are planning to bring our children ( Under 18 ) to the UK permanently and I have following questions:

1) For what visa I can apply for them?

2) Are they eligible to apply for ILR ? If not when they can applied for ILR.

3) If they are qualified to apply for ILR from India what form shall I fill to apply?

4) When will they are qulified for Naturalisation?

If both parents have ILR (or BC), the children should be eligible to get ILE (same as ILR but given outside the UK).

They are eligible to register as British citizens at the discretion of the SSHD provided that they are under 18 and at least one (ideally both) of the parents is a British citizen.
