Employment Creation - Other Shareholder Directors

Post by ryanlion » Wed Jun 15, 2016 8:45 pm

This question is in regards to an employment creation question on the latest application form, page 48. The questions on the page pertains to businesses where there are more then one partners or directors. Specifically, the last question on the table:

"If they are not part of your entrepreneur team, please list the names of the holders of the jobs they have created"

I am not sure what this is trying to imply. For instance, in my case I formed the company as a sole director three years ago. Two years ago I brought on a British Citizen partner as a 50% shareholder. He did not invest any funds nor loans (I have a £50K loan on balance). After bringing him onboard, I / the company / we hired two full time people who have been working for over 16 months each. My concern is that HO will give him 'credit' for the hires...although logic tells me that's not likely as he didn't not invest funds, nor is he a migrant applying for a visa or citizenship....am I right to assume all is ok and can answer with an accurate "none" or "zero"? Thanks.

Guidance confirms what I thought....the question is in context of a Tier 1 director or partner who is also a migrant. Ladies and gents...always question your solicitor :)

180. If you are not the sole partner or sole director in your business or businesses, you must provide all of the following:
The names of the other partners or directors
Whether any of the other partners or directors are also Tier 1 (Entrepreneur) migrants;
The dates that any other Tier 1 (Entrepreneur) migrant became a partner or director of the business;
Whether you and the other Tier 1 (Entrepreneur) migrant are team members who will be sharing evidence of job creation; and
If they have made (or are making) an application for an extension you must provide the names of the jobholders they are claiming points for.

dear user,

it means that every entrepreneur team member should provide details of their employees at their applications forms if they claiming points.

if any Entrepreneur team member changed his/her legal status and are not Tier 1 Entrepreneur Migrant (visa Holder) then the one who's want to apply for extension need to inform UKVI at the covering letter as well mule application form page 48 table 3b2b under Appendix A Paragraph 49.

Please feel free if you need further information.

You simply need to enter his name in the table as another director/partner. You will face no issues for your visa extension on this
