Refugee marrying someone on an entrepreneurial visa

Post by missdefinitelymaybe » Fri Jun 17, 2016 12:27 am

Hi all, just looking for some help on how and IF as a refugee I am eligible to marry someone on an entrepreneurial visa and what the process will be like. I have searched on the internet and I am unable to find any information on this. I want to know everything about refugees and if they are allowed to marry within their 5 year leave to remain.

Thanks to all who will help

Yes, you have the right to legally enter into a genuine marriage.

You will however need to give 28 days notice of intent to marry at one of the HO approved Registry offices. They will then be obliged to inform HO and this notice period can be extended to 70 days for HO to investigate and interview you/partner separately before they will give permission for your to go ahead and marry.

Thank you for responding.

How does my status then affect my partner especially if my refugee leave gets renewed in December? My partner's visa is valid up until February 2018. Also, the registry office has requested my birth certificate but given the state I left my home country, I am unable to provide this.

Why can't your partner keep extending his visa till he qualifies for ILR?

See this thread below for post refugee links

Thanks for replying, again :D

Yes, he probably will apply for ILR once his visa period ends but in the meantime, will his current status be affected and would I still be allowed to get married with 6 months left on my refugee status? We've been engaged for 15 months now and were planning on an October wedding

Thanks again

You can get married. The time left on your visa will not affect this.

It will be open to your partner to switch to appendix FM, but as other posters alluded, it will make little sense.
