Hi folks,

Thanks again for your previous help, much appreciated! I’d like to have your advice:

I recently got indefinite leave to remain. I invited my family members (my mum, sister and niece) to visit me at Glasgow for my graduation and a short holiday in the UK. My mum will be in the UK for 2 months, and my sister and niece will be in the UK for 1 month, and will be travelling in another 4 Schengen countries for 1 month. They 3 have got UK visa, and my sister and niece also got Schengen visa.

However, there are problems now: my flatmate who sublet the flat to me and issued me a letter to confirm that she is happy for my family to stay in our flat during their stay in the UK. However, after the letter submitted for visa application, my flatmate changed her mind and only allowed my family to stay in our flat for 2 weeks. So I thought the only solution would be to get another flat to accommodation my family, hence signed a new tenancy agreement. My flatmate was angry that I did not give her forwarding address on the notice of quit (I did give her my mobile no. and email address), although I have told her that Citizens Advice Bureau confirmed with me that I have no legal obligation to give her forwarding address. She and her partner were very aggressive when talking to me with finger pointing at me and using F word, and they intimidated that they will contact Chinese Embassy to withdraw the letter she wrote to me, since I am moving out. I don’t know if she has contacted Chinese Embassy as we are not talking any more. I am afraid she will say something bad about me to ruin my family’s visa and my family might be refused entry into the UK at the Immigration of airport.

I would be grateful if you could advise what I should do at your earliest convenience. Thanks in advance.

It is a civil matter, if any. You have new accommodation with proof so I don't see why you think it will be an issue. Things happen, things change.

Hi Char,

Thanks for your prompt reply.

I am moving to another flat this week (just 2 days before my family arriving), then will update my address with the new city council once moved. I thought as we used the letter from the flatmate, but things changed later on (i.e. circumstances changed). So when my family members arrived at airport, what address should they write on landing card? as I thought on the Home Office database, my family will stay in my current flat (i.e. my flatmate’s flat). But actually they will stay in my new flat due to things changed.

My questions are:

a. Will change of the address become an issue at airport Immigration?

b. Should I update my address with Home Office in the UK? If so, how? What documents should I submit? I can think the following:

- old tenancy agreement.
- new tenancy agreement
- a letter from the new city council which confirms my new address.
- new landlord permission for my family to stay in the flat (do I really need this??)

c. I am going to collect my family at airport. Would it be helpful if I bring the above documents just in case?

a. No it should not as long as they write your new address on the landing cards and know the situation if asked.

b. Not necessary.

c. Yes, carry them with you just in case.

Hi Char,

Thanks for your prompt reply, which is helping. One more question please: should I tell my family the situation (i.e. change of address). I have one concern: only one of my family members can speak English, but not very fluent English.In this case, would you suggest me to email the situation to my fmaily, so that they can show the Immigration Officer at airport?

Yes, explain so that he is aware and email the details so that they can complete the landing cards correctly.

Hi Char and other folks,

Thanks again for your previous help. May I ask another question about adequacy of the accommodation for my family and myself:

Sorry background again: I am moving to a one bed flat, which has one bed room, one living room, one Spam, and one toilet. The size of the flat is about 550 sq feet. And the bed room and living room is around 200 sq feet respectively. My three family members are coming for my graduation on 1 July, they are my mum, sister and niece. I will accommodate them in this flat.

I am a bit confused the number of permitted person in the flat: I understand 2 rooms would permit max 3 people to live in, but by size, seems if a room is more than 110 sq feet (sorry don’t remember the exact size here), it allows 2 persons to stay.

My question is: if I am allowed to live with my 3 family members? Actually my sister and niece will be with me in Scotland for 9 days only, as they will travel other places, but my mum will be with me in Scotland for about 2 months. I just want to make sure that I don't breach the law, if the answer is no, I will just live with my friend for that 9 days when my three family members all are here with me, my friend has offered me a place in her own flat. If the answer is yes, I will stay with family, so that save me lots of hassles travelling back and forth between my flat and my friend’s flat.
