EEA based in the UK for 26 years looking for help with PR

Hi All :D ,

Hoping you can point me in the right direction.

I was born in Portugal, I moved to the UK when I was 3 years old (I am now 29) and have lived my life in London. I am married (my wife is also EEA) and have been in the UK for 10 years.

I am applying for PR for me and my wife and am really confused with the forms I am completing.

Here are my questions:
1. Who can I use as a sponsor? (is this someone I know that is a British Citizen? Is this my wife? Is this a family member that has also lived in the UK for more than 5 years?
2. When It comes to my sponsors details do I need to provide their paye?, their work history? send off their passport. etc?
3. Do I need to provide information on all my working history from when I was 16 and started working?
and finally
4. I do not have all my payslips and might not have all my P60's whats the best alternative?

I would really appreciate some assistance.

1) If applying in own right you don't need a sponsor.

2) No - skip it. See #1

3) It depends. You certainly need to provide details for your 5 year qualifying period if applying in own right.

Who did you come to UK with in first place?
Were they exercising treaty rights?
- it may be that you acquired PR as a minor as the family dependent of an EEA parent/sponsor.
So you may have acquired PR by 2006 (when relevant Directive was transposed into UK law).

If you do apply on that basis fill in sponsor's details in section 2.

4) Letter/s from employer/s, job contracts, P45s, bonus/promotion/payrise letters; tax/NI details obtained from HMRC.

Or if applying as a dependent you would submit sponsor's details of treaty rights.

Either way you stil have to submit proof of residence in UK (& that any absences from UK were within prescribed limits).

:idea: Pro tip: It's a longshot but check the passport you used to enter UK back in 19-forgotten.
You may have been stamped into UK with ILR. How cool would that be.

I will be applying myself, so I will skip section 2 altogether! I first came with my parents to the UK (and I don't have my passport from back then! :cry: )

You mentioned the below:

How would I know if this was possible and how do I apply on that basis?

I have all my work history and can get all of my holiday dates for the last 5 years (thanks to online bookings all my flight receipts have been captured. Should I go back further to be sure that I get approved?

If parent is to be a sponsor, you apply as main applicant.
Enter parent's details in section 2 & elsewhere.

As well as evidence of your residency in UK, submit parent's evidence of exercising treaty rights from, say 2001-2006.
Also show evidence of both person's identity (passports) and relationship (your birth certificate).

If you were under 21 at the time no need to show any financial dependency on sponsor.
Even cohabitation is not mandatory (yes, free movement is so laissez-faire its that free and easy).

Refer to PR guidance (on Gov UK website for more information on all the documentary supporting evidence you will have to submit (for whichever basis you apply).
This needs to be rock-solid if not unimpeachable.

The advantage of applying for confirmation of PR dating back at least a year ago is you can then shoot directly for privilege of citizenship without waiting a further 12 months.

Thanks for all your help on this, I am going to apply myself without my parents details (as I have all the documentation I need for my application) and it seems a tad bit complicated trying to get them to tell me their work history/time out of the UK between 2001-2006 etc. If you think this is simpler than it sounds then please do let me know!

Should be fine if you have alternative evidence of your exercise of treaty rights (work-related documents).
