Is traffic offence - TS10 a criminal offence for ILR

Post by sunnyreddy » Mon Jun 27, 2016 11:15 pm

Hi Experts,

Within application for indefinite leave to remain, SET(O) Version 04/2016, page 24 it mentions:

"Note: You must give details of all criminal convictions, including spent convictions. This includes convictions for road traffic offences, including drink-driving offences, but not fixed penalty notices (such as speeding or parking tickets)."

Would traffic offence "TS10 Failing to comply with traffic light signals" come under fixed penalty notice?
No courts were involved in this and it was settled by 3 points and a fine.

Please can anyone help me in answering yes/no for criminal convictions?

Thanks in advance.

Hi Sunny,
As courts were involved in this matter it's fine.

But you must have to mention it's in the form.

for more details please read this:

Thanks

Hi Jibon,

Thanks for your response.

As I understand, I should answer 'yes' for criminal conviction and provide details in the form.

The link to the document you provided is for family members.
I'm applying for ILR as I have completed 5 years on Tier2.

I assume the TS10 to be a fixed penalty notice if you did not go to court.

I have received an FPN (Fixed Penalty Notice) for TS10.(Failing to comply with traffic signals).

The letter gave me the two options

Option 1) Accept 3 points and Pay £100 fine. (This will be classified as FPN)
Option 2) You can challenge this. If convicted, you will then be fined by the court which is not classified as FPN and then you have to disclose.
