Any updates on supremecourt challenging the 18k rule?

Post by aminegriffy » Thu Jun 30, 2016 5:57 pm

Haven't been following much but I thought that Supreme Court has challenged the rules and there was a hearing on the 23/24 of February 2016, however I cannot find anything related that matter.

I just want to know if the Supreme Court has failed to challenge the financial requirement or they postponed it meaning the rules are still in effect until later decision? and thank you.

https://www.theguardian.com/uk-news/201 ... court-told

Reports decision expected within 6 months (from Feb 2016). The Rules remain in place to date.

From what I can tell it went to court in the week you said:

I can see no mention anywhere as you state that a supreme court ruling has been made on this.

My understanding is that the rules remain in force until that decision is made.

I would rephrase that to say that the ruling is expected in about six months. It could be longer, it could be shorter, but generally that is how long Supreme Court judgments take.

On a point of interest, can any of our legal eagle members advise on what happens to references made by our courts to the ECJ/CJEU (such as the Lowndes reference) while we go through the Brexit charade?
