1. If you choose to marry in the UK you should be aware of the procedure as your fiance is a foreign national. You will have to register your intent to marry with a Home Office designated Registry Office. The Registrar is then legally bound to notify the HO who can then extend the notification period from 28 to 70 days in order to interview you both before the wedding can take place, should they choose to do so.mbhmirc1 wrote:Hello,

You have to give 28 days notice at an HO approved registery. They are obliged to inform HO of the marriage request of a foreign national and the notice period can and likely will be extended to 70 days for HO to investigate and interview each of you separately. This will happen before you are given permission (or not) to marry. Given that her visa expires soon, you likely won't get approval to marry and don't have enough time.
Failing that she'll have to apply for a fiance visa from Russia which seems crazy with her being here already. Especially since a fiance visa can be granted to someone whose never met! Uh no, one of the requirements of a fiance visa is that you have met.
So to recap we want to switch from a student visa to a spouse visa, we've not been together very long. She's well settled in the UK, we live together at my house. She has until August left on her student visa. Yes, technically she can switch to a spouse visa (once you are married) from a student visa, but see my point above.
Appreciate any advice that can be offered.
