Work rights while waiting for a EEA family permit

Post by joofville » Tue Jul 05, 2016 1:59 pm

Hi all,

I was looking for some clarification. I'm an EU national currently working in the UK. My wife entered the country with me on a six month EEA family permit. Prior to it's expiry she has now applied for a 5 year EEA family permit. So at the moment she is in limbo waiting for her letter. She has completed her bio-metrics. Is she able to apply for work or does she need to wait for the letter? She has a few interviews lined up.

Thanks in advance.

She should be applying for a residence card?

Her rights to work is automatically derived from you being a qualified person.

I think it's possible for employers to accept an EEA family permit as an excuse for her to work.
