Job offered!! Need to change Tier 2 HELP!!

I am currently on a Tier 2 (General) Sponsored visa as an energy consultant for the last year and a half. Another company has offered me a more senior position and I have accepted. My type of job is not on the UK Occupational Shortage listing, however the necessary RLMT was done for the new role, in accordance with Home Office regulations.

It is now to the stage where I need to fill out forms to start the role and send them copies of my current visa (BRP) card and passport. What are the chances that they cancel my offer? This is dream offer, I have gotten to this stage before, submitted my documents and then told they can't sponsor me due to Tier 2 restrictions. I really don't want to loose out again, if anyone has any advise what so ever please help!

My questions are:

1 What exactly is restricting them from sponsoring me if i have the right to work?
2 Is there anything I can do to prevent this?
3 What are my options? Will i need to stay in my current role until the end of my visa in 2021 ?

Is the new job offer through an employer who is an HO approved Tier 2 sponsor and will you be employed by the sponsor only, i.e. not an intermediary or umbrella company with you doing contracting?

You only have the right to work for your sponsor. If you want another job with a new sponsor (they need a sponsor license), you have to apply to switch to another Tier 2 General, with a new CoS, after the full and proper RLMT has been done.

Thanks for the response CR001. Yes the job offer is through a Registered Tier 2 A rated sponsor. I plan to resign from my current job once the CoS is sorted and only be employed with the new employer.

They have given me a conditional offer. The offer is conditional on me sending my my right to work documentation and references. HR has requested them and I have sent them. They have hundreds of sponsored staff and are accustomed to the process I'm just worried I am going to loose the offer ...

This has happened before with other A rated sponsors, hence my worry.

If they are an approved sponsor, the will know the process. If RLMT is complete, they issue a CoS to enable you to apply for Tier 2 General. I would suggest you wait for your new visa before you resign.
