How best to bring my (non EEA) fiancee to the UK

Post by Holmfirth » Tue Jul 12, 2016 2:53 pm

I am a 62-year-old British Citizen born in the UK.

I am marrying my fiancee, a Philippine citizen in the Philippines in January 2017
I want to bring her back to the UK with me to live here permanently

My wife is a 57-year-old microbiologist and a Registered Medical Technologist.

She is currently working at a Medical Centre in Kingdom of Saudi Arabia. She has worked in KSA off and on for 16 years

She will want to follow her career in the UK

We are marrying in the Philippines so the wedding receives the full blessing of her family

I understand we cannot apply for a Spousal Visa until after we are married and that there is a processing time of 4-5 weeks or a fast-track of 10 days if paid for

I do not earn enough to meet the threshold for Spousal Visa, but as I am registered disabled I believe this requirement is waived.

I want her to come back with me from Japan, obviously, not to go back to the Philippines where she doesn't live. Her contract in Saudi Arabia will expire just before the wedding. It would be very costly to renew and she would have to stay in KSA for another full year. Within her contract she cannot leave the country until the contract expiry date.

Can she come over to the UK on a different type of visa and we then apply for a Spousal Visa while she is here and living with me?

Would she be able to work while the application goes through?

How can I ensure she is in the UK with me immediately after our honeymoon, which will be in Japan?

We will do whatever we need to do to enable her to come back to the UK with me from the honeymoon, but what Visa should we apply for to enable this to happen?

If you are intent on her returning to the UK immediately you are married, her only option would be to apply well before the wedding for a points based employment visa (assuming that she qualifies and can find a sponsor) or a student visa if she has sufficient funds. She could later switch to a spouse visa if she chooses to do so. However, bear in mind that it's not permitted to switch from visitor to spouse from within the UK.

What benefits are you currently being awarded for your disability?

Thanks for your response, Casa. I am in receipt of Disability Living Allowance (High Rate) for Personal Care and Low Rate for mobility
