Should I send SA302 documents or not

Hi,

I have applied for my ILR via Tier 1 (General) route in February 2016. I have sent my documents with copy of amended tax returns form (2010-2011) and (2012-2013) as my amended revised tax calculations arrived a week later.

Now I am in dilemma whether or not to send these revised tax calculations.

I have also noticed that if anyone's visa get refused then they can't submit any additional document which means there will be no opportunity to submit these revised tax calculations however if I send them now then it might go against my application.

I believe HO can only access HMRC records till Jan 2015 so I wonder how they will be able to know that my records are already been amended and updated. To support this, I only sent the copy of amended revised tax return forms that I have submitted to HMRC as my amended revised tax calculations arrived a week later.

I am not sure what to do as my result can come at any time. I also spoke to couple of solicitors but there responses are also mixed.

Can anyone please help me on this?

Have you told HO why you had to amend your tax returns?

No, I don't think my solicitor has written any cover letter regarding these amendments.

I don't see any harm in sending revised sa302 with credible explanation. However, be prepared as HO may class it as retrospective declaration.

This is the difficult decision as they might think that I made the changes deliberately.

Do you know how long its taking postal applications before they are getting their results.

I don't really know time frame other then 6 months period and yours should be anytime if you applied in 02/16.

I am worried if i get decline then I wont have this chance to submit these documents. I wonder in AR, can we explain things via cover letter even though I wont be able to submit any supporting document such as revised tax calculations.

I am not sure what is the best solution while considering previous ILR application trends to send the revised tax calculation documents or not.

As mentioned before there is no harm in sending it now with explanation. For AR, you can post new evidence to Manchester AR team if asked but then again Admin review is based on reviewing decison based on evidence submitted at the time of original decision. So its better to send it now and have it considered regardless of admin review.

I don't think SA302 for previous years is a required document. If HO need to check your tax return, they should ideally check it with HMRC instead of just refusing you on the basis that you didn't provide an optional document. If they put an allegation of deception, I believe you can provide new evidence to challenge it anyway.

Let's see bro, I am hoping for the best and I believe it's too late for me to send these documents as I have received revised tax calculations in March itself.

I think sending them now will create more confusion. To be honest, I don't know what is the best solution so will wait and positively will get ILR.
