rahat wrote:Hi everyone,
PLEASE HELP! I really need this advice urgently.
I am currently on tier 4 student visa which expires 31st July, 2016. I am eligible for ILR 10 yr route on 15th August (within 28 day period). I am submitting an FLR (FP) application by post and then I want to vary to SET (LR) i.e. 10 yr route on 16th August, 2016. When are your exact 10 years completing , you can apply 28 days before that . yes you can apply flr fp and vary straight away when you reach the required time
1. Can I vary by booking a premium same day service? Home office will have my passport and biometric from 1st application but I can put that on form and tell the case handler that day too that these documents are with their department.yes you can do a same day service, ad you can instruct them too but you dont have to request the documents as the same days service will process your ilr in a couple of weeks if you dont have passport in many cases , also its advisable to keep a colour scan and print out of you current passports clearly showing stamped ins and outs for travels. you will have to give new biometrics on p.e.o . you can mention on your cover letter that you want to vary application, no need to tell them about your biometric
2. Can I instruct home office to send all my docs to same day centre and advise them that I am varying as same day premium service and tell them the centre etc? see above
3. Also, will I still be able to work 20hrs per week as now after I make my FLR (FP) application? yes and even full time arguably as you are student but out of term time until decision is made
Please advise guys as I will be very grateful to you for your sharing of knowledge.
Thank you,
Rahat

1. My 10 yr are actually up on 11th Sep, 2016 that's why I want to vary on 15th August, 2016. A solicitor told me I cant do same day and should post but my friend told me I can vary by same day and the case worker will retrieve my documents from Durham and hence, it will take 1-2 weeks for decision I just wanted to hear that I can do same day as I was worried they might not give my fees back.you can do a same day application, no where does it say that you cant if you haven't got the passport. i wouldn't trust most of the solicitors and do my own research
2. Thank you for giving a detailed response. I will not request them to send my docs to premium centre. Are you able to advise what wording should be included in a cover letter? Is it just a few lines that I want to vary or is there a fixed format? I guess I can just hand write it. I will take printouts of my passport pages as you say
if you have made enough posts on this forum and are not a new member you can use your inbox facility to inbox me your email and i shall send you a draft letter in which you will have to fill in your details in sha allah
3. I am doing my 1st application via my solicitor so I am going to tell my solicitor that I dont need their service for 2nd application and I will book appointment myself and fill form and go to the centre. Hope that is ok? good choice .. no need for a solicitor
4. The problem with the Tier 4 work is that I was doing a PhD which is still not complete and my University has not given me an extension as a student. I googled "employer right to work checks 2016" and in that document dated 12th July, 2016, it says that even in an 'in-time' application made before leave expires, a student can not work if they are not a student. In my case since my tier 4 will expire and my uni has not given me an extension to be a student I am worried I will have no job and cant work. What do you think?
As per the immigration rules until and unless your application is decided the previous immigration rules(tier 4 in your case) apply to you , which are 20 hours in term time and full time in off term , assuming you have finished your studies and are in off term you can work full time . a senior member is more than welcome to correct me here. I have sent in an flr o and working full time for a month. In sha allah it shouldnt be a problem
Thank you so much again.

Public forum - don't be selfish, post in public so all may benefit (and such advice may be crosschecked and verified). And by posting in public protect yourself too, as per Board T&Cs.rahat wrote:Thank you so much Zidane.
Actually my friend told me about this forum a few days ago so I new here but I am very glad I actually came because it is a very helpful place.
Would you be able to send me the draft cover letter on xxxxxxxxxxxx? I would be very grateful to you.

rahat wrote:Dear all,
Thank you for your advice. This forum is really very helpful.
1. Does anyone know if the Glasgow PEO allows varying of applications for same day appointments? or is this facility available at all PEO centres? As above, I would be varying my FLR (FP) which I would send by post to SET (LR) PEO same day.
ALL PEOS ARE SAME .IT DOESNOT MAKE A DIFFERENCE WHERE YOU GO
2. Hopefully there wont be any issue as my passport, previous bio metric, degree certificate will all be at a different home office department sent earlier with my FLR (FP).
SHOULDNT BE BUT YOU MAY NOT REVIEVE A DECISION ON THE SAME DAY ( HIGHLY LIKELY). THEY MAY GIVE YOU A LETTER STATING YOUR APPLICATION IS VALID ETC. AND YOU WILL GET THE APPROVAL SOON AFTER THE PEO CASEOWRKER GETS HOLD OF YOUR PASSPORT
3. Is it worth mentioning immigration acts and rules in the cover letter while supporting as to why you should be granted ILR 10 yr? or would the case worker feel offended that he/she is being reminded?
NOT REQUIRED . DONT TEACH THE FATHER HOW TO MAKE BABIES ( NO OFFENCE) . I DIDNOT MENTION ANY BUT ONE WHICH WAS A MINOR , CHeck the letter i emailed you . remove unnecessary info
Any thoughts guys?
Thank you again in advance.
