Employer Letter Query

Post by Rockey2016 » Wed Jul 20, 2016 12:24 pm

Hi, I am applying for ILR soon.

Q1:
Recently, I have changed my employer, on 01-June-2015.

Since then, I never travelled outside UK on any work related purpose.
I just took leaves for my annual holidays and travelled to India thrice, the max I was away, was for 24 calendar days.

Do I need to get these holiday dates mentioned on my employer letter? if yes then could you please share the sample format of the same?

Q2:
When I was with my previous employer, I was away from UK for 96 calendar days. (26-Dec-2011 to 31-March-2012)
I was on a personal leave, for my wedding, from India I worked for the same client, through the same company and on the same visa, and I was paid in Indian salary (in Rupees).

Do I need to get any letter from that employer stating that; I was working with them during "26-Dec-2011 to 31-March-2012" but on the India payroll?
If yes then could you please share some format of such letters?

Many Thanks
Rockey.

Below are my comments,

The thing about holidays is that if they are inline with annual leave entitlement (24 days per year, total of 120, varies from company) then you need not provide any additional documentation, you have to mention though. However it is better if you can and explain why you are away. Since mostly they will be paid leaves, a sample letter mentioning the reason for absences, signed by HR is sufficient. This is what I have done in my case. HR may not accept in some cases, even manager is enough I think, as he would have approved your holidays, basically someone from the company.

For the current employer a simple letter is enough. I found some sample on this forum, modified it to suit my requirements.

Basically I mentioned that I took leaves from so and so date, these are from my paid leave entitlement and I was continuously employed in UK during that period and received full salary. Some of the absences were between job changes, in those case I didn't provide any evidence as I was not employed, just mentioned in the cover letter.

As for the previous employment, you said you worked for the same client in India, what about your employment status in UK during that period? If you were employed in UK, then why did they pay in INR?

I suggest you go through "Indefinite leave to remain: calculating continuous period in UK" document.

Hi Arun,

when I came for the first time 24th July 2011, I was on a India payroll and deputed to UK.

in this model, they process full India salary and give minimum LiveExpenditure (LiveEx) say £1600/month.

I was in UK on such model from 24-July-2011 to 26-Dec-2011 then I left back to India for my wedding. When I was in India, I was working for the same client, on the same role.

When I later returned on 01-April-2012, I was on the same visa, working for the same client, same role but this time it was long term assignment and the company shifted me to UK Payroll, since then I am on UK payroll.
