Need guidance for applying Parent's Visa

Post by tammu786 » Tue Jul 26, 2016 12:12 am

Dear Friends,

I hold ILR in UK. Due to personal circumstances like parent's age, noone there to take care of them in India, I am planning to bring parents frequently to UK to stay with me. I am bit confused how this can be managed ..

Option 1: Long Term Visa (2+ Yrs)

May i know exactly what is to be shown as a proof ,, which will show the need for my parent's frequent UK visits .. say for atleast next 2 yrs?

Option 2: Standard Visitor Visa

For atleast next 15 months plan is ..

They will come here for 2 months (Nov - Dec 16) then they will return & again they will come back in Mar-Oct-17. Will there be any issue while processing visa for 2nd trip? since there is just a gap of 2 months between these 2 visits.

Kindly provide your valuable suggestions on both options..

Are you only asking about visit visas?

Have they visited the UK before and if yes, how often and for how long each visit?

They cannot be seen by HO/UKVI to be spending more time in the UK than they spend in their home country.

March to October is more than 6 months, which is not permitted.

Visit visas are for short visas, not 'residing'.

They will also require good travel insurance if have health issues as they are not permitted to use the free NHS.

Hi CR001,

Thanks for your prompt reply & Sorry for posting question in a confused state of mind. Let me re-frame my query ..

Background: Father is aged 71 & mother is aged 65. They are living in India without much of support(Mine or from other relatives). Being the only son i think at this age, they need my support.
They had been to UK for 2 months in 2015 & that was their first visit.
Basically I am planning to stay with them as much as possible. Preferably always ..

Option 1: Is there any way which will allow my parents to stay with me in UK permanently?

Option 2: "Long-term visit visas" category

May i know exactly what is to be shown as a proof .. which will justify the need for my parent's frequent UK visits .. say for atleast next 2 yrs?

Option 3: "Standard Visitor Visa"

For atleast next 12 months plan is ..

They will come here for 2 months (Nov - Dec 16) then they will return & again they will come back in Mar-Aug-17.
Will there be any issue while processing visa for 2nd trip? since there is just a gap of 2 months between these 2 visits.

Yeah i understand due to their age, I might need to take good insurance to cover any health issues.

No, not under the UK immigration rules. Adult Dependent Relative is THE most difficult visa to get and almost 100% refusal rate, which will then also shut the door on future visit visas as their intentions to settlement will have been made.
Option 2: "Long-term visit visas" category

May i know exactly what is to be shown as a proof .. which will justify the need for my parent's frequent UK visits .. say for atleast next 2 yrs?
If they have only visited the UK once, it is highly unlikely that they will be issued with a longer validity visit visa as they have no 'consistent travel history' to the UK and abiding by their visa conditions.
Option 3: "Standard Visitor Visa"

For atleast next 12 months plan is ..

They will come here for 2 months (Nov - Dec 16) then they will return & again they will come back in Mar-Aug-17.

Long term visit visa and standard visit visa are the same thing. Unlikely they will get a visa so soon after leaving the UK in December.
Yeah i understand due to their age, I might need to take good insurance to cover any health issues.
You will be high premiums for this, to cover any existing conditions, if anyone is prepared to insure them at all.

Your parents will have to convince and prove to the ECO that they are 'genuine visitors'. They will have to provide substantial evidence of their personal and financial circumstances in India.

Thank you so much for your valuable suggestions on all options. Your knowledge is really appreciable.
In this case, I will move their second journey to June-Nov-17, hope that should not be a problem then ..

Further to CR001's advice, you need to be aware that in order to have any success with an Adult Dependent visa, you would have to prove that both parents need daily care for basic tasks such as dressing, bathing, preparing food etc and that the necessary care either is unavailable in their home country, or unaffordable. If you could afford to provide the care in the UK where the costs are higher, it would be considered that you would be able to afford to support them in India.
We recently had a member on the forum whose parents ADV had been refused and consequently their next visitor visa application was also refused due to the previous intention to settle.

Thanks Casa for clarifying it further. Now i understand what do you mean by 100% rejections .. it's really impossible to get it through so it would be better if I plan to leave UK in few years & try to short term visit visa's till that time. Thanks all this forum is really great !!

Your only other option would be to use the Surinder Singh route, but the days for this may be numbered under Brexit.

OP cannot use SS route as only an ILR holder.

June - Nov is five months, way too long - visits are 2/3 weeks, five months is almost tax resident.....
