Can you get arrested attending home office interview?

Hello,
my boyfriend is Albanian and doesn't have UK visa, I'm EU citizen. We gave the notice of marriage and due he is subject to immigration the period of investigation is 70 days. Now, more than 30 days after we gave the notice the home office contacted us to go for an interview. We've heard in some cases HO try to deport the illegal person when they go to the interview, can they do this? will they retain the passport with them? should we take a lawyer with us to the interview?

Yes there is a high risk of him being detained.

Maybe.
A member's fiance was arrested on their wedding day the other month (having passed the interview and got permission to marry).
'Still detained' was the latest as reported here.

Unclear if a lawyer can help with such an arrest.

Hi I'm married to an Albanian

I know of 2 people in exactly the same situations as you

One Albanian requesting to marry a polish used a solicitor and put in an application for a correct visa before the interview - his visa was granted

The other Albanian marrying Romanian was arrested on his wedding day held in a detention centre, refused application, lost appeal and now 2 years later still fighting the home office

My advice would be to get a solicitor and put in an application urgently - they attended the address listed on the marriage request within days of asking them to attend interview.

You do need to be prepared they could detain him - I wouldn't take your passports with you as home office will keep them and it'll make it easier for them to deport him.
