ILR for dependent

Hi,

Can you please share your view.

I currently have visa till march 2017. However I am eligible for ILR WITH five year route in Feb 2016.

My wife is currently on tier 2 dependent until March 2017 as me.

My question is

When I apply for ILR in Feb 2016. What happens to her visa. She came on uk on Sep 2012. Can she continue on her tier 1 dependent visa and extend in Sep 2016.

Your help is highly appreciated.

On what date did your spouse APPLY for the Tier 1 Dependent visa?

Hi,

Sorry about the date. Both I am my wife have tier 2 general, in her case tier 2 general dependent till march 2018. I will be eligible for ILR on five year route in Feb 2017. She enetered the country as tier 2 dependent on September 2012.

She never applied for tier 1 dependent. She came to uk on tier 2 dependent on September 2012.

She Applied on 12th august- and came to UK in september

She can continue on her current visa until she meets the requirements for ILR after 5 years residence as a PBS Dep, only if you apply for ILR based on Tier 2 with 5 years residence.

Thanks. Just to be clear
I will complete my five year eligibility in Feb 2017.
My wife will complete 5 years as PBS tier 2 dependent in September 2017.

1.Can I then go ahead with my ILR application in Feb 2017. Will my wife have to change her visa status at this stage.

2.Can she continue to be a PBS tier 2 dependent while I change my status from Tier 2 general to ILR on 5 year route.

Can you please direct me to any link on this topic.

Yes, you can apply for ILR if you meet the requirements. No she will NOT have to change her visa status.

She DOES NOT have to make any extension application or change of visa application. She can apply for ILR when she qualifies in September 2017 on form Set(O).

Sorry got confused by original post which stated,

Hey guys - another question

-I started my tier 2 on 03-03-2012, I understand i will be eligible for ILR on 02/03/2017- Is this correct or will it be 03/03/2017.

- I understand I can apply for ILR 28 days in advance. So as per above dates can I make the application on 04th feb or should i wait longer

Oh for the sake of a couple of days, does it really make a difference. You can apply on ANY of the 28 days before qualifying.
