EEA - (PR) - single mother working part time

Post by robinho » Mon Aug 01, 2016 1:22 pm

Hi,
Firstly, great forum, a lot of useful info.

I'm looking for some advice regarding my situation, I've applied for my EEA PR as a single person last month and the application is being processed, my situation is straight forward, EU citizen, 12 years working continuously, P60's and all the other documents hopefully in order.

where is gets complicated is with my ex-wife and children.
We've been separated for 3 years and the children are staying with her, she does have a part time job (1 day a week, for last 6 years), and looks after the kids full time.
She is a EU citizen, had a WRS when is was required etc.
Children were born in the UK and once I get my PR I presume I can register them both as BC's

What I'm struggling to figure out is how do I help my ex get a PR - since she's only working part time to supplement income she wouldn't be classed as a worker (but I presume she wouldn't need CSI?)
I pay child maintenance regularly (around £1k a month) and she also claims some benefits.

Is she eligible for PR?
Would she be classed as self sufficient?
What sort of documents does she need to submit for a PR?
If she is not eligible for PR and I do register my kids as BC's would that be a non-resident looking after 2 BC's? :)

grateful for any input,

thanks

If you acquired PR 7 years ago then maybe your (ex)wife did (as your dependent) at that time. Its not all about the last 5 years.

Otherwise, as an EEA national, ex-wife will have to qualify in her own right.
All that is gold does not glitter; Not all those who wander are lost. E&OE.

And the critical date is the date of the decree absolute. Up until that date, she is reckoned as your family member, so may qualify from you in the same way as your children.

Are any of the children in primary school? Does she have sole custody of the children? It may be that she has a derivative right of residence; this would keep her legal until she could earn enough to become a worker.

Any children born after you had been a 'qualified person' for 5 continuous years are already British.
