Decision withdrawal letter‏

Post by kimak » Thu Aug 04, 2016 6:30 pm

Hi

I received the following email with a word documents attached.

The email states "Your appeal has now been reviewed by our Entry Clearance Manager and the decision to refuse your application has been overturned. UKVS Sheffield will contact you shortly. Please find an attached copy of the withdrawal letter which has been sent to the immigration and Asylum First –Tier Tribunal for their information."

The letter attached with the email says

I am writing to inform you that having reviewed the decision on your application on behalf of the Secretary of State I have decided to withdraw the decision of date. You will be notified of the new decision in due course.

The reason for withdrawing the decision is fresh evidence has been submitted to satisfy the ECO that the reasons for refusal have been addressed.

This letter is being copied to the Tribunal.

Then a few days later i received the following letter from the Tribunal which states

NOTICE OF HOME OFFICE DECISION WITHDRAWAL

The Secretary of State has notified the Tribunal that the decision to which this appeal relates has been withdrawn.

Under Rule 17(2) of the Tribunal Procedure (First-tier Tribunal) (Immigration and Asylum Chamber) Rules 2014 the Tribunal must treat your appeal as withdrawn unless there is a good reason not to do so.

If there is a good reason why your appeal should not be treated as withdrawn you must write to the Tribunal within the time limit set out below specifying those reasons which will be considered by the Tribunal on the papers before it.

If you consent to your appeal being withdrawn you should also inform the Tribunal of your consent.

Your reply specifying good reason for the appeal not being treated as withdrawn or consent to the withdrawal of your appeal must be received:

a) within 14 days of this notice if you are in United Kingdom
b) within 28 days of this notice if you are outside of the United Kingdom
c) in either case no later than 7 days before the hearing date (or submission date if your appeal is to be considered on the papers)

+

Does it means that the decision is withdrawn and the UKVS Sheffield will now write to me to submit the passport? If so when? It has been 18 days now.

Thanks

Hi, sorry to bump the post but do you have any update? I am on the same boat with the same letter, did you have to send a consent letter to withdraw the appeal? Many thanks.

Hi there,

I am in the same situation with the same letters.

We have just sent the letter back of consent to the appeal withdrawal.

How much longer do we have to wait from this stage? Is the next step the letter asking for the passport?

We originally started the process back in May so it is now very frustrating with the time and money it has taken so far combined with minimal information of the processes and lack of contact information to reach the correct departments!

Thanks for any help/ updates. It is very much appreciated.

Kathryn
