I have read few of the previous posts, but was unable to find a specific answer to the query i have, hence thought of posting it here. Thank you in advance.
1) I am on a Tier 2 Partner visa with my wife, who holds a tier 2 work permit visa till May 2017. I am working for an IT company.
2) She is currently with Company 'A-UK'(assume) with UK Payroll till Sep 30th 2016. Receives UK pay till Sep 30th 2016
3) From Oct 1st 2016 , Company ''A-UK'' plan to switch her to Offshore Company ''A-India''(assume) Payroll, No UK Salary but may be a UK location (My wife has not been informed yet, if she has to move to offshore location , Seems might have to stay in UK location but work with her offshore team, we are still trying to get right information on this ,if this is possible)
4) Company "A-UK" have informed her Tier 2 Work permit visa may not be cancelled till end of financial year , as this gives them flexibility of my wife continuing with UK payroll later, if needed.
Query 1 - Can my wife stay in UK as her company ''A-UK'' is not cancelling her visa? Do we need to ask any more information from the company?Like will they pay NI Tax etc?
Query 2 - Is it possible to stay in UK with an offshore pay, with COS or Tier 2 visa not cancelled? (not clear yet)
Query 3 - Can i continue to work in UK on the dependent visa, till my wife stays in UK(though she gets an offshore pay?)
Query 4 - What is the maximum number of days we can stay in UK if her company stops paying her UK salary (Flexible to allow her to Work From Home). In this case, Whats is the maximum days i can work on dependant visa.
I am trying to be proactive and gather as much information as i can , so that we can take an informed decision if we end up in a situation where my wife can stay in UK if her COS is active but she works for offshore team from UK Location.
We aren't desperate to stay in UK and do not want to get in to any legal complications. We want to be legally compliant.
Please advice. Let me know if more information is needed.
