Migration from ICT Tier 2 visa 5 years to 9 years within UK

Hi,

I came to UK on a Tier 2 ICT Long Term Staff Migrant in December 2012 and post 2 years got an extension under the same category on Jan 2016 till December 2017.

My questions are as follows:
Q1. I believe the threshold for a 9 year visa under the Tier 2 ICT Long Term Staff visa for 9 years is going to be reduced to £120000 from April 2017?
Q2. Can I within UK shift / migrate from a 5 year to a 9 year visa in case of my salary is > £120000? Without undertaking 12 months cooling period?
Q3. What are the components that are considered for arriving at the £120000 threshold?
Q4. Are there any other rules allowing me to stay in UK beyond 5 years?

Your help and references to relevant document would be appreciated. This is my first time on the board & first query. E&OE.

1. This is just a proposal and may/may not come into existence in Apr 2017. You just need to wait until then.

2. Assuming the rule change, you should be able to extend from within UK.

3. Any guaranteed part of the salary is considered. Any non-guaranteed component (such as bonus) is not considered.

4. Other option - If you are married, your spouse can become a Tier 2 main applicant if she is able to find a sponsor. You can become her dependent from within UK.
