In this question its asking my husband to declare if we have claimed child benefit or child tax credits.

I have been receiving child benefit and child tax credits as I am a British citizen.

I have read in places that I do not have to declare I do receive them as I am entitled to them.

My question is what do I do in this instant.. does he tick the box to say I receive the money or not?? Is it not fraud if we don't declare it

I will be making the application at the end of August so really need to know the answer asap.

Are you claiming child tax credits in JOINT names with your spouse?? You must claim tax credits jointly with your spouse.

You have to declare the benefits that are claimed.

Yes I am claiming tax credits in both our names as was advised to do this when I applied.

My confusion come after reading a post where JOHN has stated that it's best not to tick that you receive tax credits or child benefits as these are not classed as benefits that will affect ILR ...

so once again I repeat that if I tick the boxes to say that the wife received tax n child benefit it will not affect my ILR?

You must be honest on the form. If you are not and don't declare and HO check, which they will, you are withholding information (deception).

Claiming jointly has NO effect on ILR. The post by John are from many years ago, things have moved on since then.
