Dear Gurus,
I am a dependent on Tier 1 general.
Please can I apply for FLR(M) and I don't to depend on my husband again as I'm not sure if his ILR will come through(Tax) issue.
I have not been out of UK for 6 years, I also pay my tax as I'm employed.
I will like to hear from the Gurus.

You can only switch to FLR(M) as a spouse if your husband has ILR.

If my husband has ILR, then I will automatically have ILR too. So i would not need to go for FLR(M)

You won't 'automatically' have ILR. You would have to apply for it. You can't apply for FLR(M) as a Tier 1 dependent.

Have you been a Tier 1 G Dependent for 6 years?
Why do you think your husband will have a problem getting ILR based on Tier 1 General?
Your visa status is directly dependent on your husband unless you have your own visa, i.e. Tier 2 General or Tier 4.

If his ILR fails, your ILR or FLR(M) will also fail. The only option you would have is to apply for another visa category that you might qualify for.

You would need to have an offer from a Home Office approved sponsor and assuming your current status isn't on the list in the following link, you can only apply from outside of the UK.

You have to apply for Tier 2 General from your home country if you have a sponsoring employer and a CoS. Tier 4 I think is also from home country, but not sure.

There is Tier 1 visa on the list but mine is Tier 1 General dependent.

There is no longer an option to apply for Tier 1 General as a main applicant.
Tier 1 on the list is the Entrepreneur visa, which requires substantial documentation, business plans etc and monetary investment in a business.

As a dependent on PBS route, I don't know if there is any PBS visa on which you can switch to in-country, please let me know if there is any such option!
You may want to consider any FLRO or FLFP if you want to apply on your own and in country, just suggestions.

Just asking:
can we write things like
- there is not traffic offence/points
- we did not receive benefits
for the 5 year period for ILR
in the cover letter?

Your husband needs to answer these questions in the SET(O) form. A cover letter isn't required.

If application is sent before expiry of current visa, section 3C of the immigration rules gives the continuation of his leave to remain on his current visa. An employer can do a check online with HO to check his right to work. He will also have to wait till he gets an acknowledgment letter (if any) from HO and can produce that for his employer.
Why does he not want to apply in person?

it is also more expensive to apply in person.
do we need to wait for the acknowledgement before he can work if the employer insist?
