Tier 2 extension - how late can I leave it?

Hi all

I was wondering how late I can apply for a Tier 2 extension and still continue working. I am waiting for an EEA-route application to be granted (which may well come in just before my Tier2 expires) and want to wait until the last possible moment to avoid paying for the extension fee and IHS.

The standard route is 8 weeks -
1. Can I submit the application the day before my visa expires and still work? Or do I need to have the extension granted prior to expiry to work (at least 8 weeks to be safe)?
2. I am with the same employer, do I need to get a new CoS?
3. And how long does it take to get an IHS surcharge number?

1. Yes you can. Your existing visa conditions will continue as long as you submit your application before your visa expires.

2. Yes you need a new CoS.

3. You apply and pay online so you get the number immediately.

Do you know if extending my visa for 3 years, I also then have to pay for the NHS surcharge for the full 3 years also? Could I pay for one year and subsequently pay the other 2 later (depending on whether my EEA-EFM is granted?

No, you have to pay the Immigration Health Surcharge for the duration of the visa you are applying for. If the CoS is 3 years and you are applying for a 3 year visa, you have to pay £600 IHS (£200 per year) upfront before you can submit your application.
