peo questionaire confusion

Post by ak100 » Mon Aug 15, 2016 10:54 pm

hi forum members,
as director (tier 1 ent) i am registered for self assessment not as self employed and never been self employed but i am confused about peo questionnaire

Q1) during your residence in the uk have you worked in a self employed capacity and been registered as self employed or worked as the director or share holder of a limited company?

option) yes/no if no return questionaire to the officer

what option should i choose here ?
because next question is also tricky

Q2) what is/was the nature of you business as a self employed person?
option: sole trader/contractor/limited company (director or share-holder)/other

what should i choose here? because i am not self employed

1) You say you're a director so: Yes.

2) (director)

Don't expect common sense and joined-up thinking in these forms and questions (and wording of questions).

You say one option in Q2 is (director) - so that option applies to you, based on your answer to 1st question.
Note the "or" in Q1.

You can't suppress the fact you are a director just to make a 'good' story.

OP
Here is the link to the questionnaire handed out at the PEO. This was the questionnaire from Feb 2016 and I don't know if they have changed it since...

according to hmrc guideline a director can not be considered as self employed and just can registered for self assessment but in questionnaire except the question 1 all others question focused clearly on self employed as mentioned in question 2.
