Can I apply for ILR under 10 year

Hi,

I moved to the UK on a working holiday maker visa in October 2006. I then moved onto a work sponsorship. In 2009 i studied my masters and on 25/10/2010 I applied for my Post study visa. My student visa expired on 27/10/2010. I received notification from the home office that my application had been refused due to a misprint from the bank letter. The refusal was dated 14/12/2010. I received the notification on 30/12/2010. On the 31/12/2010 I reapplied though an agent and in February 2011 my application was approved. I have since been on work sponsor ship since 2012. My question is am I eligible for the 10 year LTR.

I was told by one immigration lawyer that it is not possible because of the gap and by another that there is technically no gap and therefore the application should be fine.

Please any advice welcome.
