ILR Application

Hello Sir,

My wife and my eldest son came to UK (April 2006) on my student visa dependent.Now I have got ILR and my wife and my eldest son are my dependent.Also,she have pass LIUK(Life in UK Test) and got B1 in speaking from Trinity College recently.

My question is ,
Can my wife and my eldest son who is 13 years apply ILR on basis of 10 years route,because as I already said they both came to UK on April 2006 on my student visa dependent?But,they have a dependent visa ( expire on 2018) from my side (ILR)
Also in finance term,how much salary do we need to earn.Because recently we both husband and wife works as a part time only but looking forward for full time.

Some body told me that SET(LR ) form to fill for the both,after going through SET(LR) form it said that SET(LR) application form is not for dependent.

If that form is not for dependent than which form is for my son who is just 13 years old have to fill when to apply a ILR
Do my son and wife have to apply individually SET(LR) application
Do they have to pay £1875 each SET(LR) form or not?

Some body told me that SET(LR ) form to fill for the both,after going through SET(LR) form it said that SET(LR) application form is not for dependent. There is nothing like dependant ILR, both your son and wife will need to apply in their own right (10 years legal residence)

If that form is not for dependent than which form is for my son who is just 13 years old have to fill when to apply a ILR. SET (LR) is the right form for both I believe, but each will need to complete their own application form.

The postal visa fee for ILR is £1,195
A premium application submitted in person at a PSC is £1,695
(Casa, not CR001)

I am clear that my wife have to fill the SET (LR) form for her ILR on the basis of 10 years in UK but I am not sure my son who is 13 years old have to fill the SE(F) or SET (LR).Can you please advice.

If both parents have ILR, then child may use SET(F).
If child satisfies 10 years legal residence, then child may use SET(LR).

Hi Vinny
just wondering to know, is it possible for the OP as child have still 2 years visa (expiring 2018)

1. father already on ILR
2. If mother apply now and get IRL

assume after one year father got citizenship and mother on ILR (one parent holds British citizenship and the other is settled in the UK)

in that case can the child directly get registered under section 3 (1) as British. as the child have still 2 years visa then OP might save the child ILR fee if this is possible.

I mean is this possible too or non-UK born ILR is must required
