If the infant was British from birth you'll have to apply for an OCI on the basis that the parents are Indian citizens - more information on the process
on this page.
However, if you are Indians then it's possible your child was registered as an Indian citizen at birth, and an Indian passport, and then you got him/her a British passport?
If so, you need to ensure you have a surrender certificate after surrendering the Indian passport. Then you can apply for an OCI for the infant on the basis that s/he was an Indian citizen himself/herself. The checklist for that is:
- Printed Application Form
- Printed & signed copy of the declaration form
- 2 photographs as per the photo specifications
- Foreign Passport Copy (photo page + Indian visa)
- Copy of Naturalisation Certificate + Original
Proof of Indian Origin
- Copy of Surrendered Indian Passport (first + last page) + Original
- Copy of Indian Passport Surrender Certificate + Original
- Copy of Parents’ Marriage Certificate + Original
- Copy of Full Version Birth Certificate of the child + Original
- Copy of parents’ Indian passports
Note: Both parents need to self-attest all the copies.
