Switching Jobs on Tier 2 General

Hi all,

I am a nurse on Tier 2 general and want to leave my hospital to work as a nurse at another hospital. I have been offered the job with a new hospital who will be sponsoring me and I have already sent off my visa extension application.

In my CoS, I wrote the start date of the new sponsor as 15 Aug 2016, however I have not received approval for my application from the Home Office yet and it's been 8 weeks. I have not resigned from my current hospital yet (i was planning to hand in my resignation when I received approval).

My notice period is 6 weeks. My question is if this application is approved, as the start date of the new sponsor was 15 Aug 2016, does it mean I will be working illegally with the current hospital during the 6 week notice period because we are already past the 15th of Aug?

If so what should I do?
