No, she only needs 2 years residence as she comes under the rules in place before July 2012.

If your son is UK born and you plan to register him as BC then no, you do not need to apply for his ILR.

Hi All,
Since me and my wife both done masters from Uk, we will showing degree of same to prove English language requirement. But because we was not married at that time so her degree got before marriage surname of 'abc' instead of after marriage 'xyz'. Her Current passport and visa's are under the name of 'xyz'
Will that be an issue or do I need to provide ant additional evidence for same?

There shouldn't be any problem if you have the marriage certificate and her name in the BRP matches the current passport. If she is applying on her own then she can fill the details in the "know by other names" section of the form.

The will have access to her previous student visa details anyway for verification if required.

Thanks for replying. In marriage certificate their is no mention of her maiden surname just after marriage surname. As I said we do have her old cancelled passport which has her old Student, PSW visa on it with maiden name. It was returned to us due to valid visa on it. Will that suffice?

ILR Form Questions

Post by Shishirus2003 » Thu Sep 08, 2016 8:57 am

Hi All,
I am just filling ILR form and not sure about following questions:

1. I have done Masters from UK so for english language(question 4.3) I ticked "the qualification was taught or researched in the UK or a majority English speaking country (other than Canada);" but its followed by question "4.5 Please provide details of your English language test:
Tick to confirm which body awarded your test:
IELTS SELT Consortium
Trinity College London
Provide the SELT unique electronic reference number provided by the awarding body:"
What shall I put in this?

2. I receive variable overtime, depending how much i have done, so do I have to mention only basic salary here or how will I calculate monthly with variable overtime? In 5.3 Are you working in the UK?, If so, what is your pay each month after income tax and other deductions?

3. There are 2 separate questions for time spent in UK and I am not sure about the answers. I was first arrived as a student (in 2008), then got psw(in 2009) and then switched to Tier 2(in 2011) and applying after completing 5 years on Tier 2. So are these questions refering to period when I first arrived as student(in 2008) or Tier 2(in 2011)

a). 6.1 When did you (the main applicant) first enter the UK? This refers to the date of your first
entry into the UK at the beginning of the period of stay on which this application is based. My guess its refering to Tier 2(2011)

b). 7.13. How long have you lived in the UK? My guess its refering to student visa(2008)

Also I received a penalty of £100 for child not wearing seat belt under section 15(3)(b) and (4). Do I need to mention same in form?

Please help
