Hi I hope someone can help me with my issue.
I know it's too early to ask this question but I hope someone can answer.
I am planning to apply for ILR 10 year long residence in November 2017. Now my issue is there are some gaps in between applications. But they are not my fault because I applied early with all of my applications but there was a delay from Home Office.
I came to UK in 2007 November and granted leave as a spouse visa valid until January 2009 (my husband applied for PSW before our visa expired on January 2009 and I applied with him)
I got my Tier 1 dependent Visa on 25th February 2009 vald until 25th February 2011. (Now there is a gap 25 days gap from Jan to Feb)
Then i was granted Visa as a Tier 2 dependent from 18th March 2011 until 25th February 2014 ( There is another gap of 21 days from Feb to March 2011 again not our fault because we filed the application before our leave expired)
There are no gaps after that. My husband got ILR in March 2016 and I applied for ILR in April using Set (M) and got refused (totally my fault because I filed the wrong form. It should have been Set (O). My documents are still with Home office and they are going to give me FLR(fp) visa now and asked me to at £500 NHS health surcharge. I paid the IHS and also wrote them a letter saying i filed the wrong form and asking to reconsider but I know they will not so no hopes.
Anyway my current Tier 2 visa won't expire until March 2017 but hopefully I will get my FLR (FP) visa this month. i will complete my 10 years November next year. What I want to know is will they refuse my ILR because of those two gaps even though it's not my fault. I have all the documents to prove I applied before my visa expired. Will it still be a problem? I really appreciate if some one can answer my question. Thank you.
