Hello all,

I have two questions that I have been trying to find a clear answer to, I’d really appreciate if anyone on the forum can answer these for me please?

1. I will be completing 5 years on my Tier-2 General work visa on the 23rd April, 2017 and I am planning to apply for same-day premium service for ILR. In the Set O guidance notes I have read that you could apply for ILR visa 28 days in advance of your 5-year legal residence if you are making a postal application. So my question is, can I apply for the ILR same-day service on the 31st March which is with in the 28 days’ limit but legally I am still short of few days of 5-year residency? Or should I apply after 23rd April?

2. My wife will be completing 4 years of residence in the UK in March 2017 as a Tier-2 General Dependent (partner/spouse) visa as she entered UK in March 2013, am I allowed to make a joint application for the ILR along with my wife or should she be applying for a visa under different category?

1. I think that you may also apply for ILR, using the premium service, no sooner than 28 days prior to the completion of your qualifying period as well.

2. If your wife initially applied for leave as your dependant from 9th July 2012, then she should extend as a PBS dependant until she completes her 5 years in the UK.
