Hello,

My Scenario:
My husband is a British citizen. He acquired his citizenship this month (earlier he was on Tier 1 Visa and obtained ILR on that basis)
I am on PBS dependent Visa now and I am eligible for ILR in April,2018 (I will complete 5 years then).

Please guide me on the below queries-
1. My husband is travelling to Switzerland (pay roll transferred from UK to Switzerland payroll) for a year. How will his absence from UK (though he intends to travel back to UK on weekends), impact my ILR application. Should he not be going on work outside UK for more than 180 days.
2. Once I obtain my ILR in April,2018. Can I immediately go for my Naturalization (as my spouse is a British Citizen)? Or Do I need to wait for one more year? Do I have to take the 5 years route or 3 year Route?

1. He is free to travel and has no restriction on days out. The important thing to remember is that your visa is WHOLLY dependent on him being present and settled in the UK. You need to maintain 'subsisting relationship' evidence if he chooses to relocate temporarily.

2. Yes, provided you were physically present in the UK exactly 3 years to the day on which you apply.
