retain right of residence eea route

Post by joe77 » Mon Sep 12, 2016 11:18 am

Hi all,

I'm a non eu married to an eu citizen on september 2012. i was on student visa that time. so i waited until it finishes and i have applied for my eea residence card on october 2014 and after all the refusals , appeals and delays finally i have got my eea family permit residence card on june 2015. problem is our relation ship is not working out now n we are kind of separated now. now she is asking for divorce. we both are working full time before marriage and still working in the same place.
my question is if i get divorce now , am i eligible for applying retain right of residence or i have to wait for two more years for my for my residence card to cover this three years. how homeoffice calculate these time period for retain right of residence. we are married for more than three years now but ive got my residence card after three years of marriage.

Thank you very much everyone, every help will be appreciated.

How did you come to that conclusion without knowing when he got married?

Than this "3 years clock is on from september 2015" is wrong.
OK. How did you come to that conclusion knowing when he got married?

He is a EU citizen family member since september 2012. The date of getting RC is irrelevant.
